| AS of 08/01/2007 TERMS AND CONDITIONS A2Z WELDING RESERVES THE RIGHT TO PHOTOGRAPH ANY PRODUCT BUILT UNLESS OTHERWISE REQUESTED! Terms are 15 days on any contracted welding done. Service guarantee or policy All welding is guaranteed to be of highest quality unless otherwise requested by customer. LIMITATIONS OF LIABILITY: It is expressly understood that A2Z Welding liability is limited to the furnishing of replacement parts. A2Z Welding SHALL NOT BE LIABLE, UPON WARRANTIES OR OTHERWISE, FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES FOR ANY DAMAGES ARISING FROM THE USE OF EQUIPMENT. Thus, A2Z Welding is not liable for any other expense, loss or damage including, but not limited to, loss of profits, production, increased cost of operation of spoilage arising in connection with the sale or use of, or inability to use our equipment or products for any reason, except as herein provided.
Privacy policy Work done for any customer will not be disclosed to any party unless legal matters deem necessary. All terms are subject to a 10.5% penalty per month beginning with the first day late. Any materials, merchandise, or equipment can be withheld regardless of value if customer fails in paying any part of invoice including penalties. Any invoice 30 days in default will subject customer to legal fees plus $1000 default penalty. A2Z Welding reserves the right, in its sole discretion, to change, modify, add, or remove all or part of these Terms, including but not limited to any term, applicable fee, policy, or guideline, at any time without notice or acceptance by You. Regardless of whether A2Z Welding has provided You individual notice, Your continued use of the Service following A2Z Welding notice or posting of changed Terms will constitute Your acceptance of such changes. It is Your responsibility to check regularly for changes to the Terms and Conditions to ensure that any contact information You provide to A2Z Welding is updated and correct. Any contract that is canceled after the start of any job is subject to a 40% contract penalty, payment for all work already completed and removal fee. If using equipment for any company, said company cannot remove equipment until all money owed is paid in full! If said company wants to remove equipment they are subject to the following: said company has 3 days to pay in full all monies that is due or they forfiet all materials, equipment, or any thing else. I still reserve the right to place a lien againts monies owed even with the forfieted items for balance due! After three days the forfitted items even if payment is made (after three days) will be considered interest paid by the company for time lost! TEXAS LAW TO APPLY, JURISDICTION AND VENUE: It is expressly understood that this sale of products, work, or equipment was negotiated, executed, consummated and is otherwise performable in Johnson county, Texas, and shall be governed, construed and interpreted as to validity, enforcement and in all other respects in accordance with the laws of the State of Texas, and the laws of the United States of America, as applicable. A2Z Welding has its principal place of business in Johnson County, Texas, which county shall be the proper place of venue to enforce payment or performance. Purchasers irrevocably agree that any legal proceeding arising out of or in connection with this sale shall be brought in the state courts of Johnson County, Texas, or the United States District Court for the judicial district in which Johnson County is located. All Terms are as said, any deviation must be in writting and sign by Edmon Mitchell and representative or customer.
